This chapter examines the concepts of mutual wills and secret trusts, describing two relevant cases. The first case involves a will that gives property to a legatee under certain conditions and the second deals with a case where two persons have made a will which includes a term not to revoke the will. The chapter explains the principle upon which full secret and half-secret trusts may be enforced and contends that mutual wills can be generally regarded as a case of constructive trust.
