This chapter analyses the legal and formal requirements for writing express trusts in Great Britain. It examines the statutory provisions relating to inter vivos transactions including contracts to create a trust or to dispose of a substituting equitable interest, declarations of trusts inter vivos, and use of a statute as an instrument of fraud. The chapter discusses the factors to consider in the creation of trusts and the disposition of equitable interests, and the relevant provisions of the Administration of Justice Act 1982.
