This chapter examines the duties and responsibilities of trustees. These include those duties arising from their acceptance of the trust and in relation to the investment of the trust property, and their obligation to keep an even hand as between the beneficiaries. Some of the key duties of trustees include statutory ‘duty of care’ and duties to act unanimously; duties in relation to information, accounts, and audit; and duties where the beneficiary is solely and beneficially entitled. The chapter also considers the rights and liabilities of trustees in relation to strangers to the trust.
