This chapter discusses European Union (EU) law and its importance in the learning and understanding of English law. The EU affects the UK in many ways and a lack of awareness of EU law will have a profound and negative impact on any understanding of the English legal system. EU law affects the way Parliament creates laws, how judges interpret and apply the law, and it provides rights and creates obligations on citizens to follow EU laws. Judges in the UK are obliged to follow EU law and in cases of ambiguity, to interpret consistently English law to give effect to EU law. EU law directly affects company law, contract law, the English legal system, and employment law. This chapter identifies the historical development of the EU and the main sources of its law, along with the institutions of the EU and the role each of them plays in the development of the Union.
