Abstract
Fixed costs rules are intended to provide certainty on how much an unsuccessful party is likely to be ordered to pay to the successful party under a party and party costs order. They are also intended to keep costs down to proportionate levels. This chapter first discusses the fixed costs that apply to simple cases which are either undefended, or where summary judgment is entered. Its main discussion is on the fixed recoverable costs rules that apply in fast track and intermediate track claims. These depend on which track the case is on; its complexity band; how far the claim has progressed; and the value of the claim. There are particular rules that apply to noise-induced hearing loss claims.
